Terms and Conditions
Article 1: General provisions
This e-commerce online store allows customers to purchase products from the online offering. The General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce web store (“Customer”). Additional terms and conditions of the Customer do not apply unless they have been expressly accepted in writing in advance.
Article 2: Price
All prices are shown in euros and, unless otherwise stated, include VAT. Any delivery, reservation or administration costs are stated separately. The quotation relates only to the items as described. The accompanying photos are for illustrative purposes and may contain elements not included in the price.
Article 3: Offer
Although the online catalog and the e-commerce webshop have been compiled with the greatest care, it may happen that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer are not binding. The seller is not liable for manifest material errors, typesetting or printing errors. If the Customer has specific questions about, for example, sizes, colors, availability, delivery time or delivery method, the Customer must contact our customer service in advance. The offer is valid while supplies last and may be changed or withdrawn at any time. The seller is not liable for the unavailability of a product.
Article 4: Online purchases
The Customer can choose between payment with the payment methods displayed on the website. The seller reserves the right to refuse an order due to a serious failure by the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
The Customer must immediately report any visible damage and/or qualitative shortcomings of an item or other shortcomings upon delivery. The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken delivery of the goods.
Article 6: Retention of title
The delivered items remain the exclusive property of the seller until full payment by the Customer.
Article 7: Right of withdrawal
This article applies exclusively to Customers who purchase items online in their capacity as consumers. The consumer has the right to withdraw from the agreement within a period of 14 calendar days, unless stated otherwise, without giving reasons. However, this right of withdrawal does not apply to customized products; these cannot be taken back or credited.
To exercise the right of withdrawal, the Customer must inform the seller in a timely manner and by an unambiguous statement (such as in writing by post or e-mail) of his decision to withdraw from the agreement. After this notification, the Customer must return the goods immediately. The direct costs of this return shipment will be borne by the Customer, unless otherwise agreed.
The seller has the right to claim compensation if the returned product has diminished in value. For a successful return, items must be in the original packaging, accompanied by all accessories, instructions and the invoice or proof of purchase.
If the agreement concerns services and the Customer has requested the start of these services during the withdrawal period, the Customer owes an amount proportional to what has been delivered up to the moment of withdrawal compared to the full execution of the agreement.
Article 8: Warranty
According to the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty takes effect from the date of delivery to the first owner. To invoke the warranty, the Customer must be able to provide proof of purchase. The (commercial and/or legal) warranty does not apply to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or changes to the item, rough use, poor maintenance, or any other abnormal or incorrect use.
Article 9: Sanctions for non-payment
Without prejudice to the exercise of other rights, in the event of non-payment or late payment, the Customer is legally liable to pay interest on the unpaid amount from the date of the breach of contract and without notice. In addition, the seller reserves the right to take back items that have not been (fully) paid for.
Article 10: Privacy Policy
The seller reserves the right to collect data from the user solely for internal use, both directly through the data provided by the user at the time of the order and indirectly (for example through the use of cookies, short data strings on the computer of the user that allow the seller to optimally tailor the content and layout of the site to the user). This data will not be passed on to organizations contractually linked to the seller. In accordance with the law of 8 December 1992 on the protection of privacy with regard to personal data, the user has the right at any time to view, change, correct and have this data deleted if he no longer wishes to receive information. to receive information about our activities. Article 11: Affect of validity – non-renunciation
If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. The failure at any time by the seller to enforce any of the rights set forth in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.
Article 12: Changes to conditions
These Conditions are supplemented by other conditions explicitly referred to and the seller’s general terms and conditions of sale. In the event of any conflict, the current Terms shall prevail.
Article 13: Applicable law and disputes
Belgian law applies to these Terms and Conditions. The courts of the Seller’s place of residence have jurisdiction in legal disputes. The Seller can also turn to the ODR (Online Dispute Resolution) platform to settle any disputes.
